Just got rear ended. Should I file a claim through my insurance or theirs? Potentially drunk guy rear ended me at a stop light. They hesitated in their car for awhile which made it seem like they were going to flee so I stood in front of their car until they got out. Luckily they have valid insurance. I'm wondering if I need to file the claim through their insurance provider in order to avoid having to pay a deductible...
